Trial date set for SABC Livhu's case

 

The hopes of Livhuwani Madadzhe, better known as comedian SABC Livhu, to walk away free were dashed on Friday morning. Instead of provisionally withdrawing murder charges, it was announced that the Director of Public Prosecution (DPP) opted to prosecute him, and a date for a High Court hearing had been set.

When Madadzhe appeared in the Thohoyandou Magistrate’s Court on 29 April, his legal representative, advocate Ntsako Hlungwani, was optimistic that the charges against his client would be dropped. Madadze is being accused of murdering his wife, Ms Lindelani Nengovhela, on 28 January last year. Nengovhela, better known as Mia Muofhe in social media circles, was found dead and floating in a water-filled disused toilet pit at their home in Sidou, Mangondi.

Madadzhe was charged with murder the same day. He was later released on R50,000 bail, with conditions attached to it.

The case had been dragging on for more than 14 months, and when Madadze appeared in court on 29 April, the defence argued that it should be struck off the roll. The State did not agree to this and asked for a final postponement to allow them to obtain the DNA results and an instruction from the DPP. The State was given three days to sort out the evidence, and it was postponed to 3 May.

When the case resumed on Friday morning (3 May), expectations were high that it would be struck off the roll, but the opposite happened. The state prosecutor told the court that the DNA results were available and based on the evidence, the DPP had decided to prosecute Madadzhe.

The trial date is set for 16 to 20 September 2024 at the Thohoyandou High Court.
